Two Tayside firefighters accused of assaulting a taxi driver in Dundee have had their case dropped due to a lack of evidence.
The two men, aged 35 and 43, were alleged to have attacked a 23-year-old on Brook Street in Broughty Ferry on January 2.
The pair — who have not been named — were detained and later charged at the city’s police headquarters on Bell Street.
But the Crown Office have revealed that the case had been dropped.
A spokesman said: “The procurator fiscal received a report concerning two men aged 35 and 43 in relation to an alleged incident in Dundee.
“Following full and careful consideration of the facts and circumstances of the case, the procurator fiscal decided that there was insufficient evidence to raise criminal proceedings.”
It is understood one of the men worked for the Scottish Fire and Rescue Service in Dundee, while the other worked out of Perth.
At the time of the incident, the pair were not suspended and were allowed to continue in their roles.
It had been claimed the incident happened after the driver asked passengers in his cab to stop eating in his vehicle.
Speaking to the Tele in the wake of the decision, the victim’s mother expressed her anger that nobody has been brought to justice for the alleged attack.
She said: “My son has been struggling to go out at night the whole year.
“He even came off the night shift because of it, but had to go back on because he needed the money.
“It has affected him both financially and psychologically, so I am absolutely appalled that nobody is being brought to justice for what happened, especially as we have yet to be informed of this.
“I don’t understand how this decision has been reached, nor why we have been left out of the loop.”
A spokesman for the Crown Office said: “While this was not a case which would automatically be dealt with by our specialist Victim Information and Advice Service, we have written to the complainer to explain our decision and will be happy to answer any questions they have.”
A spokesman for Scottish Fire and Rescue Service said: “We can confirm both individuals remain members of the Scottish Fire and Rescue Service and are currently going through our internal disciplinary procedures.”
